These terms ("Terms") govern your use of pinefall.dev and any product or service offered by Pinefall Studios ("Pinefall", "we", "us"). By accessing the site or using a Pinefall product, you agree to these Terms. If you do not agree, please do not use the site or our products.
You may use this site if you can form a binding contract with Pinefall in your jurisdiction and you are not barred from doing so by applicable law. If you're using a Pinefall product on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Some Pinefall products may require an account. You're responsible for keeping your login credentials secure and for any activity that happens under your account. Notify us right away at hello@pinefall.dev if you suspect unauthorized access.
Your use of the site and any Pinefall product is also governed by our Acceptable Use Policy. Violating that policy is a violation of these Terms.
The site, the Pinefall name, our logos, and the original content, design, and code we publish are owned by Pinefall Studios and protected by copyright, trademark, and other intellectual property laws. You may view and link to publicly available pages, but you may not copy, modify, or redistribute substantial portions without our written permission, except where allowed by law (for example, fair use) or by an open-source license we explicitly attach.
Code we release under an open-source license is governed by that license's terms, not these Terms.
You retain ownership of any content you submit to a Pinefall product. By submitting it, you grant us a limited, worldwide, royalty-free license to host, store, and display that content solely so the product can function for you.
If you send us feedback, suggestions, or ideas, you grant us a perpetual, royalty-free license to use them without obligation. You don't have to send feedback, but if you do, we'll be grateful and we'll consider it carefully.
The site and our products may link to or rely on third-party services. We don't control those services and aren't responsible for their content, terms, or practices. Your use of a third-party service is between you and the third party.
We're a small studio. We may update, change, or discontinue parts of the site or our products at any time. Where reasonable, we'll provide notice in advance for changes that materially affect existing users.
The site and our products are provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or that the site will be uninterrupted, secure, or error-free. You use them at your own risk.
To the maximum extent permitted by law, Pinefall Studios and its contributors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of the site or any Pinefall product. Our total liability for any claim relating to these Terms or the site will not exceed one hundred U.S. dollars (US$100), or, if greater, the amount you paid us in the twelve months before the claim arose.
You agree to defend, indemnify, and hold harmless Pinefall Studios from and against any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the site or products in violation of these Terms or applicable law.
We may suspend or terminate your access to the site or any Pinefall product at any time if you breach these Terms or our Acceptable Use Policy, or if continued access creates a meaningful risk to us or to others. Sections that by their nature should survive termination (such as intellectual property, disclaimers, and limitations of liability) will survive.
These Terms are governed by the laws of the United States and the state in which Pinefall Studios is operated, without regard to conflict-of-law principles. You agree that any dispute arising out of or relating to these Terms will be resolved in the courts located in that state, and you consent to their personal jurisdiction.
We may update these Terms from time to time. The "Last updated" date at the top of the page reflects the most recent revision. If a change is material, we'll post a notice on the site or notify registered users. Continued use of the site after a change takes effect means you accept the updated Terms.
